 Terms and Conditions

NOTE: Advance notice is required in order to confirm where to send all cars before receiving them to make sure all units go to correct destination.  

  1. First in ~ last out; last in ~ first out on car retrievals.
  2. No cherry picking, cars will be retrieved in sequence of stored line.
  3. Customer must notify RTSI in advance the number of railcars it wishes to store and the dates on which railcars will the tendered for storage.
  4. With advanced notice for railcar storage by Customer, RTSI will promptly advise extent of space available on subject tracks for railcar storage.
  5. Customer to deliver all rail cars empty, clean and free of accumulations or deposits of commodities previously carried.  No HAZMAT residue.  All chemical and fuel tank cars with residue will require an insurance indemnification rider naming and holding the storing Railroad and RTSI fully harmless pursuant to any and all storage situations with said residue cars, e.g., leakage, spill cleanup, or fire.
  6. Cars found to contain ANY hazardous materials will be returned to Customer at earliest available time.
  7. Hazardous spills, death or injury, or any type of environmental contamination due to hazardous materials left in the Customer’s stored in railcars are Customer’s sole responsibility pursuant to holding the Railroad and RTSI harmless in all occurrences.
  8. Railroad and RTSI reserves an absolute right at any time and in its sole discretion to reject any railcar offered for storage or to be removed.
  9. Movement of Customer’s railcars onto Railroad’s tracks is evidence that Customer has accepted the premises as suitable for storage.
  10. Federal defects found on railcars at the Interchange Point are the responsibility of the Rail Car Owner – No Exceptions.
  11. For CAGY, prefer that cars will be ordered out in no fewer than 20-cars at one time with no consideration to specific car type, prefix or cars previously loaded with a specific product.
  12. The Railroad and RTSI are not liable for charges or conditions of other rail carriers that adversely affect the Customer, e.g., car hire, demurrage, empty car disposition charges from origin or destination carrier, and constructive placement.

All daily storage fees to be invoiced on a monthly basis and switching charges will be invoiced weekly by RTSI to Customer.  All undisputed charges shall be paid in full and received by RTSI within thirty (30) days from date of the invoice.
